These Terms of Service (“Terms”) govern your use of the website located at https://dividend-wealth.com and any related services provided by Dividend Wealth (“we,” “us,” or “our”).

By accessing or using the platform, you agree to be bound by these Terms. If you do not agree, you must not access or use the platform.

Changes to These Terms

We reserve the right to modify these Terms at our discretion. If we make material changes, we will provide at least fourteen (14) days' notice before the changes take effect, by posting a notice on the platform or sending an email to the address associated with your account. Non-material changes (such as formatting or clarifications that do not alter your rights or obligations) may take effect immediately upon posting.

Your continued use of the platform after the effective date of any changes constitutes your acceptance of the updated Terms. If you do not agree with the changes, you must stop using the platform before the effective date.

Eligibility

You must be at least 18 years of age to create an account or use the platform. By creating an account, you represent and warrant that you meet this age requirement. For information about how we handle children's privacy, see our Privacy Policy.

Limitations of Use

By using this website, you warrant on behalf of yourself, your users, and other parties you represent that you will not:

• modify, copy, prepare derivative works of, decompile, or reverse engineer any materials and software contained on this website;
• remove any copyright or other proprietary notations from any materials and software on this website;
• transfer the materials to another person or "mirror" the materials on any other server;
• knowingly or negligently use this website or any of its associated services in a way that abuses or disrupts our networks or any other service Dividend Wealth provides;
• use this website or its associated services to transmit or publish any harassing, indecent, obscene, fraudulent, or unlawful material;
• use this website or its associated services in violation of any applicable laws or regulations;
• use this website in conjunction with sending unauthorized advertising or spam;
• harvest, collect, or gather user data without the user's consent; or
• use this website or its associated services in such a way that may infringe the privacy, intellectual property rights, or other rights of third parties.

Your Financial Data

When you enter portfolio data into the platform — including ticker symbols, share quantities, cost basis, and other holdings information — you retain full ownership of that data. We store and process it solely to provide the portfolio tracking, dividend analysis, and performance features of the platform.

We do not sell, license, or share your financial data with third parties for their own purposes. By default, all portfolios are private and visible only to you through your authenticated account. You may delete individual portfolios or request full account deletion at any time.

Public Portfolios

You may choose to make one or more of your portfolios public. By making a portfolio public, you acknowledge and agree that:

• The portfolio and its contents — including ticker symbols, share quantities, allocation percentages, and performance data — will be viewable by any authenticated user (including free trial accounts) or anyone with a direct link to the portfolio. Public portfolios are not indexed by search engines.
• Public portfolios are clearly labeled as “Public” in the platform interface.
• You may change a portfolio back to private at any time. Once set to private, the portfolio will no longer be accessible to other users going forward.
• Dividend Wealth cannot control, retrieve, or delete any data that was viewed, copied, screenshotted, or otherwise recorded by other users while the portfolio was publicly accessible.
• You are solely responsible for your decision to make portfolio data public. Dividend Wealth shall not be liable for any loss, damage, or consequence arising from the disclosure of data in a portfolio you chose to make public.

Brokerage Account Connections

We may in the future offer the ability to connect brokerage accounts via third-party services such as Plaid Inc. to automatically import portfolio data. By connecting a brokerage account, you would authorize the third-party provider to access your account data on your behalf and transmit it to Dividend Wealth for use within the platform.

You may disconnect a linked brokerage account at any time, at which point we will cease accessing new data from that institution. Your brokerage login credentials are never stored by Dividend Wealth — authentication is handled entirely by the third-party provider. See our Privacy Policy for details on how connected account data is handled.

Subscriptions, Payments, and Lifetime Access

Dividend Wealth offers Monthly, Yearly, and Lifetime subscription tiers, as well as a 3-month installment payment plan for the Lifetime tier. All payments are processed by our third-party payment provider (Stripe) and are subject to that provider's terms. Prices, plan availability, and promotional codes may change at our discretion; any change will not affect a subscription that is already active.

Recurring (Monthly and Yearly) Subscriptions

Monthly and Yearly subscriptions automatically renew at the end of each billing period at the then-current rate for your plan, unless cancelled before the renewal date. You may cancel at any time from your account settings; cancellation stops future renewals but does not refund the current period.

Lifetime Access

“Lifetime access” means a one-time payment grants you continued access to the Dividend Wealth platform for as long as the platform continues to operate and you remain in compliance with these Terms. Lifetime access is a license to use the platform, not a transfer of ownership of the software, content, or underlying data. You do not acquire any ownership interest in Dividend Wealth, its source code, or its intellectual property.

Lifetime access includes the features available on your subscription tier at the time of purchase, plus any features we subsequently release as part of the standard Dividend Wealth product. We reserve the right to modify, add, remove, or replace features over time. If we materially change a feature or replace it with a different feature, we will use reasonable efforts to provide equivalent functionality, but we do not guarantee that every individual feature available at the time of your purchase will remain available indefinitely.

Certain features may depend on third-party data providers, brokerage integrations, or other services outside our control. If a third-party dependency becomes unavailable, is materially changed by the provider, or becomes commercially unreasonable for us to continue offering, the affected feature may be modified or discontinued without entitling you to a refund of your lifetime payment.

If Dividend Wealth ceases operation, is acquired, or undergoes a fundamental restructuring of the product (for example, splitting into multiple separately-priced tiers), we will use reasonable efforts to provide at least sixty (60) days' written notice to lifetime members and to allow a reasonable export of your portfolio and account data. Continued access in those circumstances is not guaranteed.

Lifetime access is non-transferable. You may not sell, gift, sublicense, or otherwise transfer your account to another person. We may terminate lifetime access without refund if you materially breach these Terms, including (without limitation) any of the activities listed under “Limitations of Use.”

3-Month Payment Plan for Lifetime

When you elect the 3-month payment plan for a Lifetime subscription, you authorize Stripe to automatically charge your selected payment method for each of the three monthly installments. Access to lifetime features begins on your first successful payment and continues uninterrupted while subsequent payments are successfully processed. If a scheduled payment fails and is not cured within fourteen (14) days, we may suspend or revoke access until the balance is paid in full. The plan converts to standard lifetime access once all three installments have settled.

Refunds

We offer a 14-day refund window for first-time paid subscriptions (Monthly, Yearly, and Lifetime), measured from the date of your initial paid charge. To request a refund, contact [email protected] within the 14-day window. Renewal charges on Monthly and Yearly plans, and subsequent installments on the 3-month Lifetime payment plan, are not eligible for refund except as required by applicable law.

Promotional Codes

Promotional codes (including partner and creator discount codes) are subject to the terms displayed at the time of redemption and may be withdrawn, modified, or restricted at our discretion. Promotional codes apply only to the initial purchase or first billing period unless explicitly stated otherwise at checkout.

Account Deletion

You may request deletion of your account and all associated data by contacting us at [email protected]. Upon receiving a verified deletion request, we will permanently remove your account, personal information, and portfolio data within 30 days. Certain records (such as billing and transaction records) may be retained as required by applicable law.

Not Financial Advice

Dividend Wealth is an informational and educational tool designed to help investors track and analyze dividend-paying investments. Nothing on this platform constitutes investment advice, financial advice, tax advice, or a recommendation to buy, sell, or hold any security.

Dividend Wealth is not a registered investment advisor, broker-dealer, or financial planner. All data, calculations, projections, and analysis provided on the platform are for informational purposes only. You are solely responsible for your own investment decisions. Past performance data displayed on the platform does not guarantee future results.

Forecasts, Projections, and Algorithmic Outputs

The platform may display a variety of forward-looking outputs, including but not limited to: dividend forecasts, income projections, growth estimates, stock price projections, algorithmic buy/sell/hold signals, scoring models, risk assessments, and other analytical recommendations. All such outputs are statistical predictions generated by analytical and algorithmic models. They are based on historical data, publicly available financial information, and mathematical assumptions — they are not guarantees of future performance and should not be treated as statements of fact.

Algorithmic signals, scores, and recommendations (including any “buy,” “sell,” or “hold” indicators) are generated by automated models and do not constitute personalized investment advice. These outputs do not account for your individual financial situation, risk tolerance, investment objectives, or tax circumstances. They are provided for informational and educational purposes only.

Actual outcomes may differ materially from any forecast, projection, or algorithmic output due to factors including but not limited to: changes in company dividend policies, dividend cuts or suspensions, earnings fluctuations, stock price volatility, market conditions, economic events, geopolitical developments, corporate actions, model limitations, and data inaccuracies from third-party sources.

Dividend Wealth is not liable for any inaccuracy in forecasts, projections, scores, or algorithmic recommendations, or for any financial loss, missed opportunity, or adverse outcome resulting from reliance on any predictive or analytical output displayed on the platform. You should independently verify all financial information and consult a qualified financial professional before making investment decisions.

Intellectual Property

The intellectual property in the materials contained in this website are owned by or licensed to Dividend Wealth and are protected by applicable copyright and trademark law. We grant our users permission to download one copy of the materials for personal, non-commercial transitory use. This constitutes the grant of a license, not a transfer of title.

Disclaimer of Warranties

The platform and all materials, data, features, and services provided through it are offered on an “as is” and “as available” basis without warranties of any kind, whether express or implied. To the fullest extent permitted by applicable law, Dividend Wealth disclaims all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, and completeness.

Without limiting the foregoing, Dividend Wealth does not warrant that: (a) the platform will be uninterrupted, timely, secure, or error-free; (b) the financial data, dividend information, calculations, projections, scores, or analytics displayed on the platform will be accurate, complete, or current; (c) any errors or defects will be corrected; or (d) the platform or its servers are free of viruses or other harmful components.

Limitation of Liability

To the maximum extent permitted by applicable law, in no event shall Dividend Wealth, its officers, directors, employees, agents, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to: loss of profits, revenue, data, or investment returns; financial losses arising from investment decisions; costs of procurement of substitute services; or any other intangible losses, whether based on warranty, contract, tort (including negligence), strict liability, or any other legal theory, even if Dividend Wealth has been advised of the possibility of such damages.

In no event shall Dividend Wealth's total aggregate liability to you for all claims arising out of or relating to these Terms or your use of the platform exceed the greater of: (a) the total amount you paid to Dividend Wealth in subscription fees during the twelve (12) months immediately preceding the event giving rise to the claim, or (b) fifty United States dollars ($50.00).

You acknowledge that the fees paid by you reflect the allocation of risk set forth in this agreement and that Dividend Wealth would not enter into this agreement without these limitations on its liability.

Accuracy of Data and Materials

The materials appearing on our website are not comprehensive and are for general information purposes only. Dividend Wealth does not warrant or make any representations concerning the accuracy, likely results, or reliability of the use of the materials on this website.

Financial data, dividend information, stock prices, yields, payout ratios, ex-dividend dates, performance metrics, scores, and projections are sourced from third-party data providers and may contain errors, delays, omissions, or inaccuracies. Dividend Wealth is not responsible for the accuracy or completeness of third-party data. You should independently verify any financial information before making investment decisions.

Data Freshness and Delays

Data displayed on the platform is generally refreshed on a daily basis (approximately every 24 hours). However, data updates may be subject to delays, interruptions, or failures due to third-party provider outages, system maintenance, processing errors, or other technical factors. As a result, the data shown on the platform may not reflect the most current market information at any given time.

Dividend Wealth does not guarantee that data will be updated within any specific timeframe and is not liable for any loss, damage, or adverse outcome resulting from outdated, delayed, or stale data displayed on the platform.

Performance Metrics and Calculations

Performance metrics, portfolio returns, yield calculations, total return figures, dividend growth rates, and other computed values displayed on the platform are generated by automated calculations and may contain errors due to data inaccuracies, rounding, timing differences, corporate action adjustments, or software defects. These metrics are provided for informational purposes only and should not be relied upon as the sole basis for any investment decision.

Dividend Wealth is not liable for any inaccuracy in performance metrics or calculations, including but not limited to incorrect portfolio valuations, misstated returns, erroneous yield figures, or any other computational error. You are responsible for independently verifying performance data against your brokerage statements or other authoritative sources.

User-Entered Data

User-entered portfolio data (including holdings, cost basis, and transaction history) is stored and displayed as provided by you. Dividend Wealth does not verify the accuracy of user-entered data and is not responsible for errors in data you provide. Inaccurate user-entered data will result in inaccurate performance metrics, projections, and analytics.

Indemnification

You agree to indemnify, defend, and hold harmless Dividend Wealth, its officers, directors, employees, agents, and affiliates from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or in connection with: (a) your use of the platform; (b) your violation of these Terms; (c) your violation of any applicable law or regulation; (d) any content or data you provide to the platform, including portfolio data; (e) your decision to make any portfolio data publicly accessible; or (f) any investment decisions you make based on information displayed on the platform.

Assumption of Risk

You acknowledge that investing in securities involves inherent risks, including the potential loss of principal. By using the platform, you assume full responsibility for your investment decisions and acknowledge that Dividend Wealth provides tools and data for informational purposes only. You agree that Dividend Wealth shall not be held responsible for any investment losses, missed opportunities, or adverse financial outcomes that may result from your use of or reliance on the platform.

Right to Terminate

We may suspend or terminate your right to use the platform immediately upon notice to you (via email to your account address or through the platform) for any breach of these Terms. Upon termination, your right to use the platform ceases immediately. Sections of these Terms that by their nature should survive termination — including but not limited to Disclaimer of Warranties, Limitation of Liability, Indemnification, Assumption of Risk, Dispute Resolution, and Governing Law — shall survive.

Dispute Resolution

Any dispute, controversy, or claim arising out of or relating to these Terms or your use of the platform shall first be attempted to be resolved through good-faith negotiation. Either party may initiate negotiation by sending written notice to the other party describing the dispute. If the dispute is not resolved within thirty (30) days of such notice, either party may pursue resolution in the state or federal courts located in Mecklenburg County, North Carolina, as set forth in the Governing Law section below.

To the fullest extent permitted by applicable law, you agree that any dispute will be resolved on an individual basis only. You waive any right to bring or participate in any class action, collective action, consolidated action, or representative proceeding against Dividend Wealth, whether in court or any other forum.

Nothing in this section shall prevent either party from seeking injunctive or other equitable relief in any court of competent jurisdiction to prevent the actual or threatened infringement, misappropriation, or violation of intellectual property rights or confidential information.

Severability

If any provision of these Terms is found to be unlawful, void, or unenforceable, that provision shall be deemed severable from these Terms and shall not affect the validity and enforceability of any remaining provisions.

Entire Agreement

These Terms, together with our Privacy Policy and Cookie Policy, constitute the entire agreement between you and Dividend Wealth regarding your use of the platform and supersede all prior agreements and understandings, whether written or oral.

Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the State of North Carolina, United States, without regard to its conflict-of-law principles. You irrevocably consent to the exclusive personal jurisdiction and venue of the state and federal courts located in Mecklenburg County, North Carolina for any action arising out of or relating to these Terms or your use of the platform.
