Brokerage Account Linking Beta Participation Agreement

This Beta Participation Agreement (“Beta Agreement”) is entered into between you (“you,” “your,” or “Participant”) and Dividend Wealth (“we,” “us,” or “our”) and governs your participation in the beta program for the Brokerage Account Linking feature (“Beta Feature”). This Beta Agreement supplements our Terms of Service and Privacy Policy, which remain in full force and effect. In the event of a conflict between this Beta Agreement and the Terms of Service or Privacy Policy, this Beta Agreement shall control with respect to the Beta Feature.
By checking the consent box and connecting a brokerage account, you acknowledge that you have read, understood, and agree to be bound by this Beta Agreement.
1. Beta Program Overview
1.1. The Beta Feature allows approved participants to connect supported brokerage accounts (such as Fidelity, Charles Schwab, Vanguard, and others) to Dividend Wealth to automatically import portfolio holdings and investment transaction history.
1.2. The Beta Feature is a pre-release feature undergoing active development and testing. It is not a final, production-ready product. It will be rolled into a future general-availability release of Dividend Wealth, at which point this Beta Agreement will be superseded by the updated Terms of Service and Privacy Policy.
1.3. Access to the Beta Feature is by invitation only and is gated to approved participants via a server-side access list maintained by Dividend Wealth.
2. How Brokerage Linking Works
2.1. Brokerage account connections are facilitated by Plaid Inc. (“Plaid”), a third-party financial data service provider. When you connect a brokerage account, you interact directly with Plaid's secure interface (Plaid Link) to authenticate with your financial institution.
2.2. We never see, receive, or store your brokerage login credentials. All credential collection and authentication is handled entirely by Plaid. Your username, password, and multi-factor authentication codes are transmitted directly between Plaid and your financial institution.
2.3. Plaid's handling of your data is governed by Plaid's End User Privacy Policy. By connecting a brokerage account, you also agree to Plaid's terms. We encourage you to review Plaid's privacy policy before proceeding.
3. Data We Collect and Store
3.1. When you connect a brokerage account, we receive and store the following data from Plaid on your behalf:
- Account information: Account name, type (e.g., brokerage, IRA, 401k), and account mask (last four digits only)
- Holdings data: Security positions, ticker symbols, quantities, cost basis (where available), and current market value
- Investment transactions: Buy, sell, dividend, and other transaction records, including dates, amounts, and security identifiers
- Plaid access tokens: Encrypted tokens that allow us to refresh your data from Plaid (encrypted at rest using AES-256-GCM)
3.2. We do NOT collect or store:
- Your brokerage login credentials (username, password, MFA codes)
- Your full account numbers
- Your Social Security number or tax identification number
- Your bank account or routing numbers
- Any data from non-investment accounts (checking, savings, credit cards)
3.3. All data is stored in an encrypted PostgreSQL database hosted on Amazon Web Services (AWS) RDS, protected by encryption in transit (TLS 1.2+) and at rest, with access restricted to application servers only.
4. How We Use Your Data
4.1. Data collected through the Beta Feature is used exclusively to:
- Display your brokerage holdings alongside any manually entered portfolios
- Calculate dividend income, yield, portfolio performance, and other analytics
- Provide the portfolio tracking, dividend analysis, and projection features of the platform
- Identify and resolve bugs, errors, and data quality issues during the beta period
4.2. We will NOT use your brokerage data to:
- Sell, license, or share your data with third parties for their own purposes
- Provide personalized investment advice or recommendations
- Execute, route, or facilitate securities transactions on your behalf
- Market third-party financial products to you based on your holdings
- Generate individually identifiable reports or insights shared outside your account
4.3. We may use aggregated, de-identified data derived from beta participants (e.g., “the most commonly held dividend stock among beta users”) for platform improvement and general marketing, consistent with our Privacy Policy. This data is never tied to individual users.
5. Beta Feature Disclaimers and Acknowledgments
By participating in the Beta Feature, you acknowledge and agree that:
5.1. The Beta Feature is provided “AS IS” and “AS AVAILABLE.” It may contain bugs, errors, inaccuracies, or incomplete functionality. We make no warranties of any kind regarding the Beta Feature, whether express or implied.
5.2. Data accuracy is not guaranteed. Holdings, transaction history, cost basis, market values, dividend amounts, and other data imported from your brokerage may be inaccurate, incomplete, delayed, or missing entirely. Data discrepancies between what is displayed on Dividend Wealth and what appears in your actual brokerage account may occur. You should always verify your financial data directly with your brokerage.
5.3. The Beta Feature may be modified, suspended, or discontinued at any time, with or without notice, at our sole discretion. We are not obliged to release a general-availability version of this feature.
5.4. The Beta Feature does not replace your brokerage account or statements. It is an informational tool only. You remain solely responsible for monitoring your actual brokerage accounts, verifying transaction records, and making investment decisions.
5.5. Availability may be limited. Brokerage connections may fail, data refreshes may be delayed, and not all financial institutions or account types may be supported.
5.6. Dividend Wealth is not a registered investment advisor, broker-dealer, or financial planner. Nothing in the Beta Feature constitutes investment advice, financial advice, or a recommendation to buy, sell, or hold any security.
6. Limitation of Liability for Beta
6.1. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, DIVIDEND WEALTH LLC SHALL NOT BE LIABLE FOR ANY DAMAGES ARISING FROM YOUR PARTICIPATION IN THE BETA PROGRAM, INCLUDING BUT NOT LIMITED TO: FINANCIAL LOSSES RESULTING FROM RELIANCE ON INACCURATE DATA DISPLAYED BY THE BETA FEATURE; UNAUTHORIZED ACCESS TO YOUR BROKERAGE DATA (EXCEPT TO THE EXTENT CAUSED BY OUR GROSS NEGLIGENCE OR WILLFUL MISCONDUCT); INABILITY TO ACCESS OR USE THE BETA FEATURE; LOSS OF DATA; OR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES.
6.2. DIVIDEND WEALTH'S TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM THE BETA FEATURE SHALL NOT EXCEED FIFTY UNITED STATES DOLLARS ($50.00).
6.3. YOU ACKNOWLEDGE THAT THE BETA FEATURE IS PROVIDED FREE OF ADDITIONAL CHARGE AND THAT THE LIMITATIONS IN THIS SECTION REFLECT A FAIR ALLOCATION OF RISK.
7. Opting Out and Revoking Access
7.1. You may disconnect your brokerage account at any time through the portfolio settings in your Dividend Wealth account.
7.2. When you disconnect:
- We immediately cease accessing new data from your financial institution via Plaid
- Your imported portfolio data is soft-deleted (hidden from your account but retained in our database for 30 days in case you wish to reconnect)
- After 30 days, soft-deleted brokerage data is permanently and irreversibly removed from our systems
- Your Plaid access token is revoked and deleted
7.3. You may also revoke Plaid's access to your brokerage account directly through Plaid Portal or through your financial institution's connected apps settings.
7.4. You may request immediate permanent deletion of all brokerage data (bypassing the 30-day soft-delete window) by emailing [email protected] with the subject line “Beta Data Deletion Request.”
7.5. To withdraw from the beta program entirely, disconnect your brokerage account and notify us at [email protected]. Your standard Dividend Wealth account and any manually entered portfolios will not be affected.
8. Data Retention and Deletion
8.1. During the beta: Your brokerage data is retained for as long as your brokerage account remains connected and you are an active beta participant.
8.2. Upon disconnection: Data follows the soft-delete process described in Section 7.2.
8.3. Upon beta conclusion: When the Beta Feature transitions to general availability, your data will be governed by the then-current Terms of Service and Privacy Policy. If you choose not to accept the updated terms, you may disconnect and request deletion as described above.
8.4. Upon account deletion: If you delete your Dividend Wealth account, all data — including brokerage data, Plaid tokens, and consent records — is permanently deleted within 30 days, consistent with our Privacy Policy.
8.5. Consent records: We retain a record of your consent to this Beta Agreement (timestamp, agreement version, and user identifier) for a minimum of three (3) years after the conclusion of the beta program or your withdrawal, whichever is later, for legal compliance purposes.
9. Feedback and Communication
9.1. As a beta participant, we may contact you to request feedback on the Beta Feature, including usability, data accuracy, bugs, and feature requests. Providing feedback is voluntary but strongly encouraged.
9.2. Any feedback, suggestions, bug reports, or ideas you provide to Dividend Wealth regarding the Beta Feature may be used by us without restriction or compensation to improve the platform. You grant us a non-exclusive, royalty-free, perpetual, irrevocable license to use, modify, and incorporate any feedback you provide.
9.3. We may contact you regarding the Beta Feature via email or in-app notifications. Beta-related communications are considered transactional and are not subject to marketing opt-out preferences, though we will keep them reasonable and relevant.
10. Security Incident Notification
10.1. In the event of a security incident that results in unauthorized access to your brokerage data stored on our systems, we will notify you via email within seventy-two (72) hours of confirming the breach, consistent with applicable data breach notification laws.
10.2. We will provide you with details of the nature of the breach, the categories of data affected, and the steps we are taking to mitigate the impact.
11. Termination
11.1. We may revoke your access to the Beta Feature at any time, for any reason, with or without notice.
11.2. Upon termination of your beta access, your brokerage data will be handled in accordance with Section 8.
11.3. Sections 5, 6, 8, 9.2, and 12 shall survive termination of this Beta Agreement.
12. General Provisions
12.1. Governing Law. This Beta Agreement is governed by and construed in accordance with the laws of the State of North Carolina, without regard to its conflict-of-law principles, consistent with our Terms of Service. You irrevocably consent to the exclusive personal jurisdiction and venue of the state and federal courts located in Mecklenburg County, North Carolina.
12.2. Federal Compliance Standards. Dividend Wealth handles your financial data in accordance with the safeguarding principles set forth in the Gramm-Leach-Bliley Act (GLBA) and the data access and deletion requirements of the Consumer Financial Protection Bureau's Rule 1033 (Dodd-Frank Act, Section 1033). Your electronic consent to this Beta Agreement is governed by the Electronic Signatures in Global and National Commerce Act (E-SIGN Act, 15 U.S.C. § 7001 et seq.) and constitutes a legally binding agreement equivalent to a handwritten signature.
12.3. State Privacy Laws. To the extent applicable, this Beta Agreement and our handling of your data comply with the California Consumer Privacy Act (CCPA/CPRA), the North Carolina Identity Theft Protection Act (N.C. Gen. Stat. § 75-65), and other applicable state privacy and data breach notification laws. For California-specific rights, refer to Section 8 of our Privacy Policy.
12.4. Severability. If any provision is found unenforceable, the remaining provisions continue in full force.
12.5. Entire Agreement. This Beta Agreement, together with the Terms of Service and Privacy Policy, constitutes the entire agreement between you and Dividend Wealth regarding the Beta Feature.
12.6. Modifications. We may update this Beta Agreement at any time. Material changes will be communicated via email at least fourteen (14) days before taking effect. Continued participation after the effective date constitutes acceptance.
